Leasehold Disputes is a practical guide for anyone likely to find themselves before, or considering making an application to, a Leasehold Valuation Tribunal (LVT). It also aims to equip leaseholders and their advisers with the necessary information on their rights, and the obligations of landlords, to resolve issues without resort to the tribunal system. This book contains full coverage of the relevant case-law and legislation relating to the main areas of dispute such as service and administration charges, repairs, right to information, duty to consult, insurance, variation of leases and forfeiture. The substantive law is balanced with clear advice and tactical guidance. There is a step-by-step guide to application and hearing procedure, useful information on costs and funding, and worked examples.Since the first edition of Leasehold Disputes, all the major reforms of the Commonhold and Leasehold Reform Act 2002 have come into force and there has been a significant Lands Tribunal decision, Continental Property Ventures v White, that extensively increased both the scope of the LVT's jurisdiction and the range of arguments which are open to leaseholders to deploy. The authors have substantially reworked the text to take account of these developments. This second edition also includes: a new chapter on 'Right to Buy' - with focus on the considerable service charges leaseholders are facing as a result of local authority landlords' major works schemes; a new chapter on funding and representation - the main limiting factor when securing advice; and, expanded coverage of LVT procedure and the new powers of the LVT with respect to costs and striking out applications.
