EU Health Law & Policy Summary

EU Health Law & Policy: The Expansion of EU Power in Public Health and Health Care by Anniek de Ruijter (University of Amsterdam)

Whether there is a public health need for the containment and response to swine flu, or an individual need to access health care across the border for a hip operation to alleviate pain, the EU has an increasingly powerful role in the field of human health. Health law and policy is deeply tied into fundamental rights, bioethics and values, with important implications for individuals. However, it is also an expansive area of economic regulation, of social and state arrangements. The growing role of the EU in human health law and policy is contested, particularly as it has implications for the fundamental rights and values that are enshrined in national health law and policy. This book outlines, through case studies, how the expansion of EU power is taking place through law and policy, in both public health and health care. How is law and policy in the field of human health adopted, who are the institutional actors involved, and what is the impact of these developments for fundamental rights?

EU Health Law & Policy Reviews

Based on de Ruijter's PhD thesis at the University of Amsterdam, EU Health Law & Policy is a deeply researched book with an impressive marshalling of the literature; interestingly, de Ruijter couples her doctrinal legal analysis with qualitative research data relating the accounts of civil servants working on healthpolicy in the EU institutional context, which makes for a richer account of her findings ... EU Health Law & Policy is an excellently crafted monograph deserving of a wide-ranging audience. * Edward S. Dove, University of Edinburgh, SCRIPTed *
In any circumstances this book would be one of the best works on European Union health policy and law, and a notable contribution to research on law and society or the European Union in general. In the circumstances of COVID-19 it is also one of the most important ... this book is a fine piece of scholarship whose timeliness is a favor to all of us. * Scott L. Greer, University of Michigan, Journal of Health Politics and Law *
